Agreement and eligibility
These Terms and Conditions (“Terms”) form a binding agreement between you and Cyster concerning the Cyster mobile application, website, and related support or content (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and legally capable of entering this agreement. If you do not agree, do not use the Services. If mandatory consumer law where you live gives you additional rights, these Terms do not remove those rights.
What Cyster provides
Cyster offers tools for PCOS education, cycle awareness, daily wellbeing tracking, journaling, nutrition and exercise resources, medication reminders, optional connected health data, AI-assisted chat, and AI-assisted meal analysis. Features may differ by device, country, app version, permission settings, or release stage.
The current Services primarily store profile and wellbeing records on your device and do not provide a cloud user account. Clearing app storage, deleting the app, changing devices, or losing a device may permanently remove local information unless your platform backup restores it.
We may add, change, suspend, or remove features to improve safety, comply with law, address technical limits, or develop the product. We will provide notice when required by law.
Medical and AI limitations
Cyster is not a healthcare provider or emergency service. The Services provide general education, organization, and wellbeing support. They do not diagnose, treat, cure, or prevent a disease and are not a substitute for professional medical care.
Do not delay or disregard advice from a qualified clinician because of something shown by Cyster. For urgent symptoms or an emergency, contact your local emergency service. Review our full Medical Disclaimer before using health, AI, nutrition, exercise, medication, fertility, or pregnancy-related information.
Artificial intelligence
AI-generated text and meal estimates can be incomplete, inaccurate, outdated, or inappropriate for your circumstances. AI output is not reviewed by a clinician before you receive it. You are responsible for evaluating output and seeking professional advice when a decision may affect your health, medication, fertility, pregnancy, or safety.
Do not use Cyster Care to report emergencies, request a diagnosis, decide whether to start or stop medication, or replace individualized medical advice.
Your responsibilities
You agree to:
- use the Services lawfully, safely, and only for personal, non-commercial purposes;
- provide information you are entitled to provide and keep device access reasonably secure;
- check important records, reminders, AI responses, and nutrition estimates before relying on them;
- respect intellectual-property, privacy, and other rights; and
- follow applicable app-store, device, health-platform, and network terms.
You must not:
- reverse engineer, scrape, copy, resell, or exploit the Services except where law expressly permits;
- upload unlawful, harmful, deceptive, infringing, malicious, or privacy-invasive content;
- attempt to bypass safeguards, probe security, overload infrastructure, or interfere with another person’s use;
- present AI output as professional medical advice or use the Services to make high-impact decisions for another person; or
- use exercise-media links, catalogs, or other protected content outside the intended app experience.
Your content and permissions
You retain ownership of information and content you provide, including profile details, logs, journal entries, chat messages, photos, meal descriptions, and feedback (“User Content”).
You grant Cyster and its service providers a limited, worldwide, non-exclusive license to host, transmit, format, and process User Content only as reasonably necessary to provide, secure, support, and improve the features you request, comply with law, and enforce these Terms. This license ends when the content is deleted from systems under our control, subject to reasonable technical and legal retention.
You confirm that you have the rights and permissions needed to submit User Content. Avoid submitting another person’s face, health information, private communications, or documents without their appropriate consent.
Product feedback and suggestions may be used to improve Cyster without payment or attribution, provided we handle personal information as described in the Privacy Policy.
Paid features and app-store purchases
Cyster may offer subscriptions, trials, or one-time purchases in the future. Before a purchase, the applicable app-store page will show the price, billing period, included features, trial terms, and renewal information.
Purchases made through Apple or Google are billed and managed by that store. Unless the purchase screen says otherwise, subscriptions renew until cancelled through your app-store account settings before the deadline shown by the store. Refunds and billing disputes are handled under applicable law and the store’s rules.
Store listing terms control if they conflict with this section for payment processing or cancellation. Nothing here creates a paid obligation before you actively confirm a purchase.
Ownership and third-party services
Cyster and its licensors own the Services, including the app and website software, design, Cyster name and petal mark, illustrations, editorial presentation, original content, and compilations, excluding User Content and properly attributed third-party materials. These Terms give you a limited, revocable, non-transferable right to use the Services for their intended purpose; they do not transfer ownership.
The Services may rely on or link to third-party platforms, content, or services, including Apple, Google, Microsoft Azure, Azure OpenAI, PostHog, and media or educational sources. Third parties operate under their own terms and privacy practices. Cyster is not responsible for third-party services outside our reasonable control.
Availability and termination
We aim to keep Cyster useful and available, but the Services may be interrupted, delayed, changed, or unavailable. Internet access, device compatibility, platform permissions, and third-party services may affect features. Reminders and notifications can fail and should not be your only method for managing medication, appointments, or urgent care.
You may stop using Cyster at any time. We may limit or end access when reasonably necessary for security, legal compliance, misuse, non-payment of a paid feature, or discontinuation of the Services. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—remain effective.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Cyster disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. We do not warrant that any insight, estimate, reminder, AI response, or educational content will be complete or suitable for you.
To the maximum extent permitted by law, Cyster and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or opportunities; or harm caused by reliance on health information, missed reminders, device loss, third-party services, or unauthorized access outside our reasonable control.
Where liability cannot be excluded, liability is limited to the maximum extent the law permits and to loss that was reasonably foreseeable and directly caused by the relevant breach. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory liability for fraud, wilful misconduct, or death or personal injury where applicable. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
You agree to indemnify Cyster against third-party claims arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights, but only to the extent permitted by law and caused by your conduct.
Governing law, changes, and contact
These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of competent jurisdiction in India will have jurisdiction over disputes, except where mandatory consumer law allows you to bring a claim in another forum or requires another law to apply.
Before starting formal proceedings, you and Cyster agree to make a reasonable good-faith effort to resolve the issue by email, unless urgent relief or applicable law makes that inappropriate.
We may update these Terms as the Services or law changes. Material changes will receive the notice required by law. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A delay in enforcement is not a waiver. These Terms and referenced policies are the entire agreement concerning the Services.
